Traffic Violations and DWI/DUI/OWI-What to Do If Arrested

Upon being accused of serious traffic and driving violations, most individuals inevitably focus on the possible consequences. Will I lose my license, and for how long? Will I go to jail? Will I lose my job? Will my insurance rates rise?

While awareness of potential consequences is important when making final legal decisions, please consider that there are also simple immediate steps you can take to protect your rights, freedom and driving privileges. At the Public Information Center for D.C. Traffic Law, attorney John Spaulding takes great pride in providing you with information about what to do if arrested.

What to Do if Arrested

  • If you have been accused of criminal speeding (driving 30 miles per hour over the posted speed limit), hit and run resulting in personal injury, or DUI/DWI/OWI, you can prevent summary suspension of your Washington, D.C. driving privileges. We can help with this important step at no charge. A fax to the Department of Motor Vehicles within administrative deadlines serves as proof of a request for a hearing. Your suspension will be placed back in pending status and your driving privileges will be retained until your hearing. Please do not hesitate to call us for assistance or information.
  • If you face repeat criminal charges, including DWI/DUI stemming from high blood alcohol concentration levels, early or immediate entrance into an alcohol treatment program can sometimes lessen your punishment. Courts may show leniency if you can demonstrate that you are working to resolve the problems that led to your arrest.
  • If you have been in an accident, investigate your insurance policy to determine applicable coverage of resulting bodily injury and property damage. Also, take all possible steps to ensure that your insurer has made payment for applicable and covered damages. This step can illustrate to the court your intentions to rectify the damages caused by your behavior.
