You can be charged with driving while intoxicated or driving under the influence even when there is no alcohol in your system. If you are pulled over by a police officer under suspicion of drunk driving, you will normally be asked to take a breathalyzer test. If that test shows a low level of alcohol in your blood, but you are acting as if you are very intoxicated, Washington, D.C. law allows the police to take a urine sample from you.
Once they have collected the sample, they will send it to a lab to be analyzed, to see if there were any drugs in your system that could have accounted for your behavior when you were driving or after you were pulled over. Generally, the results from a urine sample aren't available for several weeks after the initial arrest. This can raise many issues that do not generally come up in traditional drunk driving cases.
